PARTICIPANT WAIVER AND RELEASE In consideration of my participation in the Hub Rugby, Learn to Play 2024 Season occurring in Brookline, Massachusetts from April 7, 2024 through December 31, 2024 (“Event”) organized by Hub Rugby, Inc. (“Hub Rugby”), I hereby agree to and acknowledge the following, which applies to my participation in all activities associated with the Event: VOLUNTARY PARTICIPATION. I acknowledge that my participation in the Event may involve physical activities, and I acknowledge that there may be risks and dangers associated with these physical activities, including without limitation the risk of bodily injury. By my participation in the Event, I certify that I participate in the Event voluntarily, that I am aware of these inherent dangers and that I am aware of, and will fully comply at all times during the Event with, all applicable laws and any rules imposed by the Event organizers that are communicated to me by or on behalf of Event personnel or Hub Rugby. I further acknowledge that the information provided at the Event is not intended as medical advice and does not replace the diagnostic and treatment services of physicians. ASSUMPTION OF RISK: IN CONSIDERATION OF BEING ALLOWED TO PARTICIPATE IN THIS EVENT, I HEREBY PERSONALLY ASSUME ALL RISKS IN CONNECTION WITH THE EVENT FOR ANY HARM, INJURY, LOSS OR DAMAGE THAT MAY BEFALL ME WHILE I AM A PARTICIPANT, WHETHER FORESEEN OR UNFORESEEN. MEDICAL RELEASE & CONSENT. I hereby release and forever discharge Hub Rugby from any claim whatsoever that arises or may arise on account of any first aid, treatment, or medical service, including the lack or timing of same, rendered in connection with my participation in the Event. I hereby consent to emergency medical treatment if I am injured while participating in the Event. MEDIA AUTHORIZATION. In connection with the Event, I consent and permit the reproductions by Hub Rugby of photographs, of myself, without compensation for advertising or other purposes. I release Hub Rugby, their agents, servants, employees, contractors, consultants, representatives, designees, assignees, and affiliates from liability or any violation of any personal and/or proprietary right I may have in connection with such reproduction or use. RELEASE OF LIABILITY. I understand I am responsible for my own conduct and decisions while participating in any Event and further agree that this Participant Waiver and Release will apply to any claim arising out of my participation in all activities while a participant in the Event. I, for myself and for my heirs, beneficiaries, executors, administrators, successors and assigns, hereby release Hub Rugby and all Event partners and co-sponsors, and their respective, as relevant, directors, officers, agents, employees, consultants, members, and affiliates, and each other participant and volunteer in the Event, and all such parties’ respective successors and assigns, and, as applicable, heirs, beneficiaries, executors and administrators (all such released parties referred to collectively as “Released Parties”) from all liability for any loss, liability, damage, injury or expense, whether arising under contract, tort (including negligence), or otherwise, including without limitation any liability for injury to my person or property or to the person or property of others, or otherwise, incurred by me while on the Event, or in any way connected with the Event. I UNDERSTAND THAT THIS RELEASE INCLUDES ALL CLAIMS AGAINST HUB RUGBY ARISING FROM HUB RUGBY’S ORDINARY NEGLIGENCE, EVEN IF IT IS SOLELY OR SEPARATELY NEGLIGENT. In addition to the release set forth in this section, I agree to indemnify, defend and hold harmless Hub Rugby and its officers, directors, employees and agents from and against any and all losses, liabilities, claims, actions, suits, demands, obligations, costs, expenses (including, without limitation, reasonable attorneys’ fees and expenses) which result from, arise in connection with or are related in any way to my participation in the Event. INTERPRETATION. I agree that this release is intended to be as broad and inclusive as permitted by the laws of the Commonwealth of Massachusetts, and that this release shall be governed by and interpreted in accordance with the laws of the Commonwealth of Massachusetts. In the event any provision of this release is held invalid by a court, that shall not otherwise affect the enforcement of the remaining provisions. KNOWING AND VOLUNTARY EXECUTION. I have carefully read this release and fully understand its contents. I AM AWARE THAT THIS IS A CONTRACT BETWEEN MYSELF AND HUB RUGBY AND CONTAINS AN ASSUMPTION OF RISK AND A RELEASE OF LIABILITY, AND I SIGN IT OF MY OWN FREE WILL. By signing this release, I certify that I am eighteen (18) years of age or older or have delivered the consent of my parent or guardian to Hub Rugby. This document when signed by me does not need to be signed by Hub Rugby or any other party and will be valid and binding upon me, and will be enforceable, without any party’s signature other than my own, will be binding upon and will inure to the benefit of my successors and assigns and my heirs, beneficiaries, executors and administrators, and the successors and assigns of Hub Rugby, and cannot be amended or modified except in a writing signed by the undersigned or the undersigned’s legal representative and by an authorized representative of Hub Rugby. I affirm that I have been given adequate time for my satisfactory review of this release and to ask questions about this release to my satisfaction, and I understand that the terms of this release will control over any contrary oral or other written agreement or statement.
